The 40th Annual Environmental Permitting Summer School, hosted by the Florida Environmental Network, brought together more than 1,400 attorneys, consultants, engineers, state and local government officials, developers, landowners, and other environmental professionals. Gunster and Arrow Group attorneys and advisors led and participated in a collection of panels providing comprehensive, timely insights into Florida's environmental, water, mineral, waste, energy, air quality, and property rights regulatory frameworks, as well as legislative developments. Below are the main topics that emerged throughout the conference.
Water Issues Take Center Stage
A significant emphasis throughout the conference was placed on water issues affecting Florida, including large-scale restoration projects concerning the Everglades and efforts to reverse coastal damage caused, in part, by historical drainage projects. Water Management District and Florida Department of Environmental Protection leaders shared the latest information on water restoration projects, showcasing incredible progress, including restoration efforts for the Indian River Lagoon, presented by SJRWMD Executive Director Mike Register during the Comprehensive Watershed Management panel.
A Legislative Shift from Water Quality to Water Quantity
Based on conversations amongst legislators regarding updates on Everglades restoration, we anticipate Florida will see a shift in legislative emphasis in the coming years. Many projects currently underway are focused on addressing water quality issues, and as those are completed and funding is allocated to operations, the focus is expected to shift toward water quantity. Meeting the demands of Florida's growing population will likely require developing more alternative water sources, and we anticipate corresponding policy and budget changes to address those needs.
PFAS, Data Centers, and Energy: Areas to Watch
Discussions around PFAS (including House Bill 1019), data centers, and energy continue to play an increasingly important role in the Florida environmental landscape, and we anticipate increasingly robust discussions at future conferences as regulatory and market developments continue to accelerate in these areas.
Water Quality Enhancement Areas: Rulemaking in Focus
There was considerable discussion centered on DEP's rulemaking to allow Water Quality Enhancement Areas (WQEA). A new draft of the rule and corresponding financial assurance changes were released on the first day of the conference. Gunster will continue monitoring these developments to ensure clients have effective and usable tools to mitigate environmental impacts.
Agricultural Shifts and Water Demand
A notable geographical shift in agriculture is occurring across the state. Irrigated acreage is declining in South Florida while increasing in North Florida, particularly around the Suwannee River. This trend will drive a need to address growing water demands and evaluate how changing agricultural practices may affect the springs region if the shift continues.
