Construction LawGunster’s Construction Law Practice represents developers, general contractors, subcontractors, suppliers, design professionals, associations and owners in all facets of construction law and litigation. For decades, Gunster has advised many of the region’s largest developers on a wide array of legal issues from basic development to sophisticated and complex multi-party litigation.

From the planning and financing stage through the completion of construction, the Practice resolves disputes through the most efficient means including negotiation, mediation, arbitration, and litigation.

Gunster’s Construction Law practice includes three board-certified construction specialists.

Contract Drafting and Analysis

In addition to drafting unique project specific contracts,  we utilize the major professional organizations’ form construction contracts including the American Institute of Architects (AIA), the Engineers Joint Documents Committee (EJCDC), ConsensusDOCS, Associated General Contractors of America (AGC), and the Design-Build Institute of America (DBIA).

We routinely counsel clients on negotiating various provisions of construction contracts,  including change orders, delays, claim preservation, liquidated damages, and indemnity.

Design Defects

Our lawyers have represented clients in many types of construction defect cases, ranging from defects associated with multi-million dollar commercial projects to class-action construction litigation to the construction of single-family homes.

Construction Liens and Bonds

We have expertise in Florida’s Construction Lien Law, as well as with both public and private  payment/performance bond issues.  Gunster’s lawyers have represented lienors and owners on private projects, as well as clients in connection with bonded projects.  Our lawyers have provided continuing education lectures to clients regarding the always-changing lien and bond statutes.

Alternative Dispute Resolution

We represent clients in state and federal court throughout the United States.  We have also represented clients in administrative, mediation and arbitration proceedings throughout the country.
