Gunster’s ESI Program
Gunster’s electronically stored information (ESI) support team is an interdisciplinary group comprising attorneys from nearly every practice area of the Firm. In light of the diversity of legal expertise amongst its members, Gunster’s ESI support team is well suited to handle any problem at hand since assigned members are not only familiar with the client’s e-discovery obligations but also the substantive area of law underlying the case. As a result, the client can rest assured that its electronic records are being reviewed and processed by individuals knowledgeable in the subject matter of the documentation. Moreover, this diversity in expertise assists the litigation team in better understanding the scope of electronic documents available to prosecute or defend the client’s position.
Gunster’s ESI support team is currently managed by Scott W. Dangler, a shareholder in the Firm’s Business Litigation Practice Group. Mr. Dangler has more than ten years experience counseling clients in all aspects of e-discovery, including issuance of litigation holds and preservation letters, the continuation or suspension of existing document retention procedures, data mapping the client’s electronic data infrastructure, compliance with the federal and state rules of civil procedure regarding e-discovery, and development of litigation readiness plans. Mr. Dangler is experienced with the use of third party e-discovery management systems, such as Iron Mountain’s Stratify, AccessData’s CT Summation, Fios’ Prevail and Clearwell’s E-Discovery Platform, to meet a client’s e-discovery demands.
The scope of e-discovery matters which Mr. Dangler has managed range from simple breach of contract actions with limited e-discovery to large, complex intellectual property and securities litigations with significant e-discovery comprising terabytes of data and millions of electronic records. For example, Mr. Dangler currently manages the e-discovery obligations of a nationwide banking client involved in multiple litigations across the country regarding issuance of mortgage-backed-securities. The document review team under Mr. Dangler consists of more than forty attorneys located in offices throughout the state. The e-discovery team, to date, has reviewed more than four million electronic documents and produced more than a million.
