JACKSONVILLE, Fla. (November 14, 2008) — Michael Cavendish, a commercial litigation attorney and shareholder in the Jacksonville office of Gunster, is the author of the cover feature of the Florida Bar Journal’s new November issue. Titled “The Concept of Arbitrability Under the Florida Arbitration Code,” the article provides a comprehensive foundation to Florida’s native law on arbitration.
Directed to Florida CEOs, general counsel, transactional lawyers and judges, Cavendish developed the piece to serve as a desktop guide to determine whether homegrown Florida legal disputes are arbitrable, i.e., subject to a private arbitration proceeding in place of a public court suit. The article, reviewing state statutes and Florida Supreme Court opinions, focuses on legal contests between Floridians, as opposed to those based on interstate commerce.
Cavendish is a litigator focusing on complex commercial disputes, environmental law, real estate and finance. His recent appearances include providing class action counsel to a publicly traded bank holding company, serving as lead trial counsel to a division of a Fortune 100 bank, and acting as lead environmental liability trial counsel to Florida-based private developers.
He is the author of two collections of legal essays, a dozen articles in state and national legal journals, and chapters on evidence and procedure in the Lexis Publishing books Evidence in Florida and Florida Civil Practice Before Trial.
Cavendish served an appointment to the Florida Bar’s Civil Procedure Rules Committee from 2003 to 2007. Named a member of Florida’s Legal Elite by Florida Trend Magazine, and cited for a notable string of wins in 2006 by BusinessWeek Magazine, Cavendish is also a member of the Florida chapter of the Order of the Coif. AV rated as independently determined by Martindale Hubbell, he received his J.D. and M.A. from the University of Florida, and his bachelor’s degree from Florida State University.
