FinCEN Proposed Rule Expanding Section 314(a) Requests/Foreign Law Enforcement Agencies and State/Local Law Enforcement
On November 16, 2009, the Financial Crimes Enforcement Network ("FinCEN") issued a Notice of Proposed Rulemaking that will significantly expand the information sharing program of Section 314(a) of the USA Patriot Act to allow certain foreign law enforcement agencies as well as State and local law enforcement agencies (investigating terrorist activities or money laundering) to request that FinCEN solicit on their behalf information from U.S. financial institutions.
