New Florida Growth Management Law (Community Planning Act, House Bill 7207) Challenged by the Town of Yankeetown, Florida

This year, the state of Florida significantly changed its growth management policies with the passage of the Community Planning Act (House Bill 7207). Florida Legislature: Mid-Session Tallahassee Update

The Florida House has a marathon session scheduled, where it is expected to take up several bills including HB 7129, a major Growth Management bill that would remove most state oversight of local land-use decisions. Other important bills under consideration include HB 1355, a controversial Elections bill, HB 7095, the House legislation dealing with Prescription Drugs and HB 1231, which would Deregulate Basic Phone Service. The session starts on the 20th at 3:45 p.m. and is scheduled to go until 10 p.m. The House is also scheduled to meet from 2:30 p.m. to 7 p.m. on Thursday to continue the discussions and debate on these matters.


Insurance Coverage May Cover Madoff Clawback Settlement Payments

Tomorrow is the deadline for Irving Picard, the Madoff trustee, to file fraudulent transfer (“clawback”) lawsuits against Madoff net winners. Several high profile individuals, including Carl Shapiro and Robert Jaffe, recently settled the claims against them. The clawback litigation is expected to last for many years, and the costs to defend and resolve these lawsuits will be massive and crippling even to the most wealthy individuals and organizations. Defendants may have directors & officers, errors & omissions, or other liability insurance to pay for the cost to defend these lawsuits. Insurance may also cover some or all settlement or judgment payments.
